Terms of Service
§ 1 Preliminary provisions
- The QR Badger online store, available at https://qrbadger.pl, is operated by Leszek Janiszewski under the business name finefabric.io, registered in the Central Registration and Information on Business (CEIDG) kept by the minister competent for the economy, NIP 8992822151, REGON 367698192.
- These Terms are addressed both to Consumers and Entrepreneurs and define the rules of using the online store as well as the rules and procedure for concluding distance Sales Contracts with the Customer via the Store, including rules for order returns and use of the Features available in the Application.
- Creating an Account in the Store, concluding a Sales Contract, and further use of the Application by the Customer require full and unconditional acceptance of these Terms.
§ 2 Definitions
- Consumer – a natural person concluding a contract with the Seller within the Store, the subject of which is not directly related to their business or professional activity.
- Seller – a natural person conducting business activity under the name finefabric.io Leszek Janiszewski, registered in CEIDG kept by the minister competent for the economy, NIP 8992822151, REGON 367698192.
- Customer – any entity making purchases via the Store.
- Entrepreneur – a natural person, legal person, or an organizational unit without legal personality, to which a separate act grants legal capacity, conducting business activity in their own name and using the Store.
- Store – the online store operated by the Seller at https://qrbadger.pl.
- Distance contract – a contract concluded with the Customer within an organized system of concluding distance contracts (within the Store), without the simultaneous physical presence of the parties, using exclusively one or more means of distance communication up to and including the moment the contract is concluded.
- Terms – these Store terms and conditions.
- Order – the Customer’s declaration of intent submitted via the Order Form, directly aimed at concluding a Sales Contract for one or more Products with the Seller.
- Account – the Customer’s account in the Store, where the data provided by the Customer and information about Orders placed by them in the Store are stored.
- Registration Form – a form available in the Store enabling the creation of an Account.
- Order Form – an interactive form available in the Store enabling placing an Order, in particular by adding Products to the Basket (Bag) and specifying the terms of the Sales Contract, including the method of delivery and payment.
- Basket – a part of the Store software where the Products selected by the Customer for purchase are displayed, including their price and total amount. In this Store it is called “Torba” (Bag).
- Product – a movable item/service available in the Store and the subject of the Sales Contract between the Customer and the Seller.
- Sales Contract – a contract for the sale of a Product concluded or to be concluded between the Customer and the Seller via the online Store. Depending on the characteristics of the Product, “Sales Contract” also means a contract for the provision of services or a contract for specific work.
- Application – software consisting of two main components: the Store and the Gadget Manager, designed to run on mobile and desktop devices, enabling users to purchase gadgets (Products) and manage them.
- Gadget Manager – a tool integrated with the Application that offers users Features for personalization, configuration, and management of purchased gadgets (Products).
- Features – a set of tools and options available within the Gadget Manager in the Application, enabling users to interact with purchased gadgets (Products), personalize them, and manage them.
- External Authentication Service Provider – a third party enabling Customers to sign in to the Application/Store using existing authentication solutions such as Google OAuth or Discord OAuth.
- External Payment Service Provider – a third party enabling Customers to make payments to perform the Sales Contract.
- Delivery – receipt by the Store of products required to perform the Sales Contract.
- User – a natural person using a Product purchased under a Sales Contract concluded by the Customer, regardless of whether they are a party to that contract. The User may be different from the Customer if the Product purchased by the Customer is transferred, gifted, or otherwise made available to a third party who did not participate directly in the purchase transaction.
- Product Activation – permanently assigning the Product to the User’s account in the Application, preceded by giving the Product a name and re-confirming these Terms.

§ 4 Technical requirements
- To use the Store, including browsing the assortment, placing Orders for Products, and using the remaining Features of the Application,
the following are required:
a. An end device with Internet access,
b. An active e-mail account,
c. The latest version of an installed web browser,
d. Enabled cookies and JavaScript.
§ 5 General information
- To the broadest extent permitted by law, the Seller is not liable for disruptions in access to the Application, including interruptions in its operation caused by instability of Internet infrastructure (including servers), force majeure, unlawful actions of third parties, or incompatibility of the Application/online Store with the Customer’s technical infrastructure.
- The Seller reserves the right to introduce necessary technical breaks, including for maintenance works of the Application or servers.
- Browsing the Store’s assortment does not require creating an Account. Placing Orders by the Customer for Products available in the Store is possible after creating an Account in accordance with § 6 of the Terms.
- Prices shown in the Store are in Polish zloty (PLN) and are gross prices (including VAT).
- If the price in the Basket differs from the price on the Product page, the price on the Product page applies.
§ 6 Creating an Account in the Store
- To create an Account in the Store, you must:
In both cases, acceptance of these Terms is required.
a. Fill in the Registration Form (providing e-mail address and password), or
b. Use an External Authentication Service Provider.
- Creating an Account in the Store is free of charge.
- Signing in to the Account is done by providing the login and password set in the Registration Form or by using an External Authentication Service Provider.
- The Customer may at any time, without giving reasons and without incurring any fees, delete the Account by sending an appropriate request to the Seller, in particular via e-mail or in writing to the addresses indicated in § 3.
§ 7 Rules for placing an Order
- The Customer is required to provide correct personal and address data.
- To place an Order, the Customer should take the following steps:
2.1 select the Product being the subject of the Order, then add it to the Basket by clicking the “Wrzuć do Torby” button
2.2 in the Basket (Bag), click the “Kupuję” button, which leads to the summary
2.4 fill in the Order Form by entering the recipient’s details and the address for delivery of the Product, and select the type of shipment (delivery method)
2.5 select one of the available payment methods
2.6 click the “Płacę” button and complete the payment on the website of the selected External Payment Service Provider
§ 8 Performance of the sales contract
- The Sales Contract between the Customer and the Seller is concluded after the Customer places an Order via the Order Form in the online Store in accordance with § 7 of the Terms. An integral part of placing an order is a successful payment result processed by the External Payment Service Provider.
- After placing an Order, the Seller promptly confirms its receipt and simultaneously accepts the Order for processing. Confirmation of receipt and acceptance for processing is made by sending the Customer an e-mail to the Customer’s e-mail address. Upon receiving a successful payment result for the Products, the Sales Contract between the Customer and the Seller is concluded.
- In the case of ordering Products with different availability dates, the shipping date will be the Delivery date to the Store of the last required Product in the Order.
- Delivery of the Product is carried out only within Poland.
§ 9 Right of withdrawal
- The Consumer may withdraw from the Sales Contract within 14 days without giving a reason, with exceptions specified in item 7.
- The period specified in item 1 begins upon delivery of the Product to the Consumer.
- Withdrawal from the Sales Contract is carried out by returning the purchased Products to the Seller within the period specified in item 1, or by informing the Seller of the intention to withdraw from the Contract.
- Effects of withdrawal from the Contract:
6.1 In the event of withdrawal from a distance contract, the contract is deemed not concluded.
6.2 In the event of withdrawal from the Contract, the Seller shall reimburse the Consumer promptly, no later than within 14 days from receiving the Consumer’s declaration of withdrawal from the Contract, all payments made by the Consumer.
6.3 The Seller shall reimburse the payment using the same payment methods that were used by the Consumer in the original transaction.
6.4 The Seller may withhold reimbursement until the Product is received back.
6.5 The Consumer is obliged to send the Product back to the Seller’s address provided in these Terms without delay, no later than 14 days from the day on which they informed the Seller of withdrawal from the Contract. The deadline is met if the Consumer sends the Product back before the expiry of 14 days.
6.6 The Consumer bears the cost of returning the Product.
6.7 The Consumer is liable for any diminution in the value of the Product resulting from using it in a manner that goes beyond what is necessary to establish the nature, characteristics, and functioning of the Product.
- The Consumer is not entitled to withdraw from a distance contract with respect to a Contract:
a. where the subject of the service is a non-prefabricated item produced according to the Consumer’s specification or serving to meet their individualized needs,
b. for services, if the Seller has fully performed the service with the express consent of the Consumer who was informed before the performance began that after the service is performed by the Seller, they will lose the right to withdraw from the Contract,
c. where the Product shows signs of use or damage, or is incomplete.
d. where the Product that is the subject of the Sales Contract has been Activated in the Application system, which is equivalent to using it beyond what is necessary to establish the nature, characteristics, and functioning of the Product. Product Activation in the Application is equivalent to using it. The Seller reserves the right to verify the Product Activation status in order to confirm its used condition.
§ 10 Complaints
- The Sales Contract covers new Products.
- The Seller is obliged to deliver to the Customer an item free of defects.
- In the event of a defect in goods purchased from the Seller, the Customer has the right to submit a complaint under the provisions on warranty (rękojmia) in the Civil Code.

- It is recommended that the complaint include, among others: a concise description of the defect, photos, circumstances (including the date) of its occurrence, the Customer’s data, and the Customer’s request related to the defect.
- The Seller will respond to the complaint request promptly, no later than within 14 days, and if they fail to do so within this period, it is deemed that the Seller accepted the Customer’s request as justified.
- Goods returned as part of the complaint procedure should be sent to the address specified in § 3 of these Terms.
§ 11 Out-of-court complaint handling and claims
- Detailed information on the possibility for the Consumer to use out-of-court methods of complaint handling and pursuing claims, as well as the rules of access to these procedures, is available at the offices and websites of county (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Provincial Inspectorates of the Trade Inspection, and at the following website addresses of the Office of Competition and Consumer Protection: http://www.uokik.gov.pl/spory_konsumenckie.php; http://www.uokik.gov.pl/sprawy_indywidualne.php and http://www.uokik.gov.pl/wazne_adresy.php.
- The Consumer has the following exemplary possibilities to use out-of-court methods of complaint handling and pursuing claims:
a. The Consumer is entitled to apply to a permanent consumer arbitration court referred to in Article 37 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws 2014, item 148, as amended) with an application to resolve a dispute arising from a contract concluded with the Seller.
b. The Consumer is entitled to apply to the provincial inspector of the Trade Inspection, pursuant to Article 36 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws 2014, item 148, as amended), with an application to initiate mediation proceedings to amicably settle a dispute between the Consumer and the Seller.
c. The Consumer may obtain free assistance in resolving a dispute between them and the Seller, also using the free assistance of the county (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection (including the Consumer Federation and the Polish Consumers Association).
§ 12 Personal data in the online Store
- The controller of Customers’ personal data collected via the online Store is the Seller.
- Customers’ personal data collected by the controller via the online Store is collected for the purpose of performing the Sales Contract, and if the Customer consents — also for marketing purposes.
- Recipients of the personal data of online Store Customers may be:
a. If the Customer uses delivery by postal shipment or courier shipment in the online Store, the Controller provides the collected personal data to the selected carrier or intermediary handling shipments on behalf of the Controller.
b. If the Customer uses electronic payment methods or a payment card in the online Store, the Controller provides the collected personal data to the selected entity handling such payments in the online Store.
- The Customer has the right to access the content of their data and to correct it.
- Providing personal data is voluntary; however, failure to provide the personal data indicated in the Terms as necessary to conclude the Sales Contract results in the inability to conclude such contract.
§ 13. Rules for using the Application and responsibility for content
- The Application allows users to personalize the Product (gadget) by modifying the content of the QR code. The User may, using the Application, change the QR code content, including adding links to websites.
- The User acknowledges and agrees that they bear sole responsibility for all content placed, modified, or transmitted via the Application, including links to external websites contained in the QR code. The Seller is not responsible for user-generated content or the consequences of its use, including access to harmful content or websites.
- The User undertakes not to publish via the Application content that violates law, good customs, the rights of third parties, discriminatory content, offensive content, or content promoting violence.
- The Seller reserves the right to block or limit access to the Application if the User is found to be acting contrary to the Terms, legally questionable, or potentially harmful.
- The Seller is not liable for damages resulting from improper use of the Application by Users, including using the Application to place links leading to harmful websites.
§ 14 Final provisions
- Contracts concluded via the online Store are concluded in the Polish language.
- The Seller reserves the right to amend the Terms for important reasons, i.e. changes in legal provisions, changes in payment and delivery methods — insofar as these changes affect the performance of these Terms. The Seller will inform the Customer of each change at least 7 days in advance.
- In matters not regulated by these Terms, generally applicable provisions of Polish law shall apply, in particular: the Civil Code; the Act on Providing Services by Electronic Means; the Consumer Rights Act; and the Personal Data Protection Act.
- The Customer has the right to use out-of-court methods of handling complaints and pursuing claims. For this purpose, they may submit a complaint via the EU ODR online platform available at: https://ec.europa.eu/consumers/odr/
